DMCA & Copyright Policy

1 Our Respect for Intellectual Property

FollowXchange respects the intellectual property rights of others and expects our users to do the same. Although we operate primarily in India, we voluntarily comply with the Digital Millennium Copyright Act (DMCA) to accommodate our international user base, satisfy hosting and ad-network requirements, and demonstrate our commitment to protecting copyright owners worldwide. We will respond expeditiously to claims of copyright infringement committed using the FollowXchange platform.

2 Reporting Infringement

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through FollowXchange by sending an email with the following information:

  • Your full legal name, telephone number, and email address.
  • A precise description of the copyrighted work that you claim has been infringed.
  • The exact URL or a detailed description of where the allegedly infringing material is located on our website.
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  • Your physical or electronic signature.

3 Our Response Process

Once a complete and proper DMCA Takedown Notice is received, we will take the following actions:

  1. Review: Our legal team will review all valid complaints within 5 business days.
  2. Removal: If the complaint is deemed valid, the infringing content will be removed or access to it will be disabled within 48 hours of the review's conclusion.
  3. Notification: We will promptly notify the user who posted the allegedly infringing content that we have removed or disabled access to it.
  4. Repeat Infringers: FollowXchange maintains a strict repeat infringer policy. We will terminate the accounts of users who are found to repeatedly violate the intellectual property rights of others.

4 Counter Notification

If you believe that your content was removed (or access was disabled) by mistake or misidentification, you have the right to file a Counter Notice. Your Counter Notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where the material appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email address.

If a valid Counter Notice is received, FollowXchange will send a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, the removed content may be restored in 10 to 14 business days.

IMPORTANT LIMITATION REGARDING INSTAGRAM:

FollowXchange is a platform hosting user activity, not user content. We do not host, store, or display Instagram posts, photos, or videos. We only display public Instagram usernames as text-based references for our exchange community. If you have a copyright dispute regarding an actual photo or video posted on Instagram, you must submit your DMCA request directly to Instagram/Meta Platforms Inc.

All copyright infringement notifications and counter-notifications should be sent to our designated Copyright Agent:

7. India Specific Note (IT Act Compliance)

In addition to the DMCA, FollowXchange operates in strict compliance with the Indian Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
